Live Life Cycling Adventures - Reservation terms & conditions

1) Booking and deposit

A booking with Live Life Cycling Adventures is confirmed upon receipt of the required deposit of $1,500 AUD per person, unless otherwise specified, and acceptance of these Reservation Terms & Conditions.

50% of the deposit is refundable if the booking is cancelled more than 100 days prior to the scheduled departure date. After this time, the deposit is non-refundable.

By making a booking and paying the deposit, the guest acknowledges that they have read, understood and agree to be bound by these Reservation Terms & Conditions.

2) Payment terms

The remaining balance of the tour price must be paid in full no later than 60 days prior to the scheduled departure date.

If the final balance is not received by the due date, Live Life Cycling Adventures reserves the right to treat the booking as cancelled by the guest. Cancellation fees will then apply in accordance with Section 3.

3) Cancellation by the guest

All cancellations must be made in writing to Live Life Cycling Adventures. A cancellation will only be effective once written confirmation of the cancellation has been acknowledged by Live Life Cycling Adventures.

Cancellation fees are as follows:

  • More than 90 days prior to departure: loss of deposit.
  • 90 days or less prior to departure: 100% of the total tour price is payable.

The above cancellation fees apply regardless of whether the guest has paid the final balance at the time of cancellation.

4) Outstanding payments following cancellation

Where a booking is cancelled within 90 days of the scheduled departure date, the full tour price remains payable.

If the final balance has not been paid at the time of cancellation, the outstanding amount becomes immediately due and payable.

Live Life Cycling Adventures reserves the right to recover any outstanding balance in accordance with these Terms & Conditions and applicable law.

5) Cancellation costs and losses

Cancellation fees are intended to reflect the costs, commitments and liabilities incurred by Live Life Cycling Adventures in arranging and operating the tour.

These costs may include, but are not limited to, accommodation, transport, guides, staff, equipment, logistics, administration and payments or commitments made to third-party suppliers. Many of these costs are non-refundable or become non-refundable as the departure date approaches.

6) Amendments and transfers

Requests to transfer a booking to another person may be considered at the sole discretion of Live Life Cycling Adventures.

Any approved transfer may be subject to additional administration fees, supplier charges or other costs incurred as a result of the transfer.

A transfer is not guaranteed, and the replacement guest must meet all applicable participation and booking requirements.

7) Travel insurance — Mandatory

Comprehensive travel insurance is mandatory for all guests participating in a Live Life Cycling Adventures tour.

Guests must ensure that their travel insurance provides appropriate coverage for their individual circumstances, including, where applicable:

  • cancellation and amendment costs;
  • medical and hospital expenses;
  • emergency evacuation and repatriation;
  • loss, theft or damage to personal belongings and equipment;
  • travel delays and disruptions; and
  • cycling and cycling-related activities undertaken as part of the tour.

Guests are responsible for ensuring that their policy provides adequate coverage for the activities and destinations included in their tour.

Live Life Cycling Adventures accepts no responsibility for losses, costs or expenses arising from a guest's failure to obtain adequate travel insurance.

8) Failure to pay

If any payment is not received by the applicable due date, Live Life Cycling Adventures reserves the right to cancel the booking and apply the relevant cancellation fees set out in these Terms & Conditions.

Any outstanding amount may remain payable following cancellation in accordance with Section 4.

9) Debt recovery

Where a guest fails to pay an amount due under these Terms & Conditions, Live Life Cycling Adventures reserves the right to recover the outstanding amount as a debt.

This may include referring the matter to a third-party debt collection agency or taking other appropriate recovery action.

To the extent permitted by law, any reasonable costs incurred in recovering an outstanding debt may be added to the amount owing.

10) Pricing and changes

Tour prices are based on the costs and information available to Live Life Cycling Adventures at the time of booking.

Live Life Cycling Adventures reserves the right to amend prices where necessary due to circumstances outside its reasonable control, including but not limited to:

  • currency fluctuations;
  • changes in accommodation or supplier costs;
  • changes in transportation costs;
  • changes in government charges, taxes or fees; and
  • operational or logistical requirements.

Where a significant change is required, Live Life Cycling Adventures will endeavor to provide reasonable notice to affected guests.

11) Liability

To the maximum extent permitted by law, Live Life Cycling Adventures will not be liable for loss, damage, injury, death, delay, cancellation or additional expense arising from circumstances beyond its reasonable control.

This includes, but is not limited to, accidents, illness, weather conditions, natural disasters, road closures, strikes, industrial action, transport disruption, government restrictions or the acts or omissions of third-party suppliers.

Live Life Cycling Adventures acts as an organiser and coordinator of cycling tours and may engage independent third-party suppliers, including accommodation providers, transport operators, guides and other service providers.

To the maximum extent permitted by law, Live Life Cycling Adventures is not responsible for the acts or omissions of those independent third-party suppliers.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded, restricted or modified under applicable Australian consumer law.

12) Governing law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any dispute arising in connection with these Terms & Conditions or a booking with Live Life Cycling Adventures will be subject to the applicable courts and tribunals of Queensland.

13) Charge backs and payment disputes

Guests agree to contact Live Life Cycling Adventures and provide a reasonable opportunity to resolve any genuine payment dispute before initiating a chargeback or payment dispute through their financial institution.

Where a charge back is determined to be unjustified, Live Life Cycling Adventures reserves the right to seek recovery of any reasonable costs incurred in responding to or disputing the charge back, to the extent permitted by law.

This clause does not limit any rights a guest may have under applicable consumer protection or financial services laws.

14) Tour participants and conduct

Live Life Cycling Adventures reserves the right, acting reasonably, to decline, remove or refuse to retain any participant whose behavior is disruptive, unsafe, unlawful or materially interferes with the enjoyment, safety or well-being of other guests, guides or staff.

Where a participant is required to leave a tour due to their conduct, Live Life Cycling Adventures will not be responsible for any additional costs incurred by that participant as a result, to the extent permitted by law.

All participants are required to comply with reasonable instructions provided by Live Life Cycling Adventures, its guides and representatives throughout the tour.

It is a mandatory condition of participation that all guests wear an approved bicycle helmet whenever cycling as part of a Live Life Cycling Adventures tour.

15) Changes to these terms & conditions

Live Life Cycling Adventures reserves the right to amend or update these Terms & Conditions from time to time.

Any revised Terms & Conditions will take effect from the date they are published, unless otherwise stated.

The Terms & Conditions applicable to a booking will be those accepted by the guest at the time the booking is confirmed, subject to any changes that are required by law or otherwise expressly agreed between the parties.

16) Acceptance of terms

Payment of the booking deposit constitutes confirmation that the guest has read, understood and accepted these Reservation Terms & Conditions.

These Terms & Conditions form part of the agreement between the guest and Live Life Cycling Adventures in relation to the booked tour.
